General Terms and Conditions of Maintenance (AWB)
1. Warranty, Duration and Scope of Services
The purpose of a warranty and/or maintenance contract is to minimize inconvenience and cost to the customer in the event of a qualified repair case for a wine refrigerator or cigar humidor.
Services under the warranty and/or maintenance contract include in particular:
- Arrival of a technician
- Working hours of the technician
- Any transport of the device
- Spare parts
- If necessary, replacement and equivalent replacement of the device
Fault diagnosis: Prior to any repair visit, SWISSCAVE performs a fault diagnosis (by telephone and/or e-mail). This requires the customer to provide information about the condition of the device and the environmental and operating conditions, such as temperature measurements, display readings over a meaningful period of time, checking and localizing unusual noise sources, etc. It may be necessary to ask several follow-up questions in order to establish a targeted diagnosis before a technician is dispatched. The objective is, where possible, to carry out the repair in such a way that the root cause can be remedied in a single visit.
Duration: Maintenance contracts are concluded at the same time as the purchase of the device and commence on the date of delivery or provision of the device. Maintenance may be extended up to the fifth (5th) year.
The announced maintenance fee refers to one device at a time.
If several identical or similar devices are installed at the same location, the warranty or maintenance extension must cover all such devices. It is not possible to cover only part of the installed devices.
Devices up to 24 months: The described scope of maintenance, including equivalent replacement of the device, applies in cases where a repair cannot be carried out in an economically reasonable manner.
Devices from 24 months: Maintenance may be extended beyond the age of 24 months by mutual agreement. In such cases, the maximum repair effort and/or the partial entitlement to a replacement device (if repair is not economically reasonable) decreases linearly with increasing age, as follows:
Age – Maximum total expenditure in % of the purchase price of the device (net, excluding accessories):
24–36 months: 80 %
36–48 months: 60 %
48–60 months: 50 %
Our service under the maintenance contract consists, at our discretion, of supplying replacement parts for justified complaints regarding components due to material or manufacturing defects or remedying the corresponding defects of the delivered goods by repairing them either in our factory or on site. In principle, a repair will be carried out, if necessary with multiple repair attempts. There is no entitlement to replacement, price reduction or rescission, except where, in our opinion, a repair is not economically justifiable and is therefore not undertaken.
Transports: Device pick-ups and deliveries to floors (stairs) in connection with repairs are only included in countries where SWISSCAVE generally offers floor deliveries. In all other countries, any necessary device pick-up or delivery will take place at curbside. Unless otherwise agreed in a separate written agreement signed by both parties, the warranty and/or maintenance contract is limited exclusively to the repair or replacement of the damaged delivery items. The customer must ensure that the necessary dates and time windows for repairs, collections and deliveries can be met, that a responsible person is present at the agreed time, that the device is freestanding (removed), easily accessible, that sufficient space is available for the repair, and that the device is clean and completely empty (all contents to be cooled, such as wine bottles or cigars, have been removed).
Note on the 5-year extended warranty (registration requirement):
Any extended warranty of five (5) years for selected models in accordance with the General Terms and Conditions (GTC)
of SWISSCAVE AG is not an automatic component of this warranty or maintenance contract. The extended warranty is
granted only if the product is registered online with its correct serial number using the official SWISSCAVE
registration form within one (1) month from the date of purchase. If the product is not registered within this period,
the statutory warranty period of two (2) years for natural persons shall apply. Mandatory statutory rights remain
unaffected.
If operating or maintenance instructions are not followed, modifications are made, parts are replaced or consumables are used that do not comply with the original specifications, any claim for repair under this warranty or maintenance contract shall be void. This also applies where defects are attributable to improper use, storage, installation or handling of the device, third-party intervention or the opening of the device. Excluded from the scope of this contract are also damages caused by force majeure, excessive stress, unsuitable operating equipment, extreme environmental influences, epidemics, pandemics, war or other extraordinary circumstances. Insignificant deviations from the warranted properties of the goods as well as minor scratches, discoloration, inaccuracies of digital displays, temperature or humidity values, etc. do not give rise to any maintenance claims. Costs and damages of any kind beyond the repair or, at our discretion, replacement delivery—particularly dismantling, reinstallation, installation in cabinet systems, emptying or refilling the device, and cleaning—are not covered.
Liability for normal wear and tear as well as for consumables and accessories is excluded. Maintenance and other claims against SWISSCAVE are available only to the direct purchaser and are not transferable. Replacement of parts, assemblies or entire devices does not result in new maintenance periods. SWISSCAVE shall be liable only for damage caused intentionally or by gross negligence. Liability for indirect or consequential damages, including loss of profit or data, is excluded.
Customs formalities and costs in connection with repair cases outside the European Union (EU), the United Kingdom (UK), Switzerland (CH) and the Principality of Liechtenstein (FL) are the responsibility of the customer and must be organized, handled and paid by the customer. The same applies to customs formalities in connection with spare parts deliveries or tool transports outside the EU, the UK, CH and FL.
2. Exclusion
If operating or maintenance instructions are not complied with, unauthorized modifications are made, parts are replaced or consumables are used that do not meet the original specifications, any repair claim under this warranty or maintenance contract shall be void. This also applies if defects are caused by improper use, storage or handling, unauthorized intervention or opening of the device. Damage caused by force majeure, excessive stress, unsuitable operating equipment or extreme environmental influences is likewise excluded. Insignificant deviations from the guaranteed properties of the goods, such as minor scratches or discoloration, inaccuracies of digital displays, temperature or humidity values, etc., do not trigger any maintenance claims. Costs and damages exceeding the repair or, at our discretion, replacement delivery—particularly dismantling, installation, emptying, refilling or cleaning of the device—are not covered.

3. Duty to Provide Information
The parties shall inform each other in good time of any special technical requirements as well as of any legal, regulatory or other provisions applicable at the place of destination insofar as these are relevant for the performance of the contractual services. Furthermore, the parties shall inform each other without delay of any obstacles that may jeopardize contractual performance or lead to inappropriate solutions.
4. Applicability
The General Terms and Conditions (GTC) of SWISSCAVE AG shall apply to this warranty and/or maintenance contract, unless expressly agreed otherwise.
5. Final Provisions
The place of jurisdiction shall be exclusively at the registered office of SWISSCAVE AG or in Freienbach, Switzerland. The parties shall endeavour to resolve any disputes arising out of or in connection with the performance of this contract amicably.
